Attention PineWild Owners:

 

Starting Monday March 8th, 2010, weather permitting, Joe Benigno Tree service will be at PineWild for approximately 7 days to trim and remove some trees from the property.  The trees that will be affected have been reviewed by the arborist and permitted by the TRPA.  The trees are throughout the PineWild property. Dear PineWild Homeowners:

 

Happy New Year!  Several important events have occurred since my last letter of November 9th, 2009.

 

Lise and Bill Bandes are Leaving PineWild:

They sold their beautiful home, unit 130, to PineWild’s newest members Joan and Jim Scatena on December 31st, 2009. Bill, an owner for 29+ years, lived here full time for 8+ years. He served PineWild for many years as a Board member and Chairman of the Beach Committee and Tennis Court Committee. Bill was proactive in his love for PineWild and work diligently to preserve the best qualities of beautiful Lake Tahoe for future PineWild generations. I will miss Lise and Bill as they move to Roseville in April. Welcome to Joan and Jim Scatena. They worked with Sam McMullen, Bill and their agent to include in their closing a document formally transfer responsibility for the skylights to them and they went the extra mile to close the sale by year’s end.  

 

Robert Jester:

Thank you Jess, Board member and Chair of the Insurance Committee, for single handily securing comprehensive insurance coverage for PineWild at an excellent price. While you are not a candidate for reelection, I hope you remain Insurance Chair. Brilliant job!

  

Restated CC&Rs Adopted:

As of January 12th, 2010, PineWild is being governed by the Restated Conditions, Covenants and Restrictions (CC&Rs). These CC&Rs are in compliance with Nevada state law and address new developments in PineWild. The vote was 97 for and 7 against, surpassing the required 60% (81) votes. The driving forces were Chairman Bill Cobb and Sam McMullen, supported by members Ray Weigle, Lex Adams, myself, and other members. On page 3 is my 29-year historical summary of the CC&R approval process entitled “My 29-Year CC&R Odyssey”.

My 29-Year CC&R Odyssey

 

Approval of the Restated CC&Rs was once-in-a-life-time accomplishment having its roots in the work of many talented individuals since the CC&R’s initial adoption in 1974. I will briefly recount the contributions of several individuals, based on documents in my historical CC&R file, beginning in 1982. If I have left out other participants and important contributions, I apologize. Please note how the identification of many of the CC&R amendments developed from the issues, concerns and special developments within PineWild throughout the 29 years.

 

In 1982 John Bartko reviewed the CC&Rs citing the time-share concept, the need for a separate reserve fund with a long-term plan, and unanticipated problems with paragraph 20 requiring 75% approval of all members for amendments. In 1985 Robert Chester wrote an opinion on the contradictions in CC&Rs and their 1978 amendment between equal and unequal dues. In 1988 Mark Leonardo, an attorney, offered (at $225/hr) to amend the CC&Rs to address enforcement of liens and the power to levy larger fines and other remedies. In 1989 Lester Berkson, our attorney, proposed language to deal with the Class A and B membership and mentions “with the advent of the TRPA, the likelihood of annexation is very remote.” In 1990, under the direction of President Chuck Neff and CC&R Chairman John Kurylo, Lester Berkson wrote the paragraph 20 amendment changing the required approval from 75% (102 votes) to 60% (81 votes). It passed. I will live in perpetuity as the Attorney-in-Fact!

 

In 1992 Lester Berkson advised the CC&R committee on how to best proceed with a rewrite – delete baggage, develop a list of what is not covered, add catch alls to cover the future, etc. In 1994 Bob Havranek wrote an opinion on equal assessments for re-roofing within “projects”. Interesting enough, he also addressed the process for funding the Garage/Tennis-Court project funded by the sale of individual parking spots. Ray Weigle and I actively supported roof and siding capital assessments based on each unit’s area. Harold Petersen spoke eloquently and with his special presence that PineWild is a harmonious Community in which all are equal – the position finally and correctly adopted. In 1994, Robert Havranek motioned that the CC&Rs be “amended to address areas of omission and ambiguity”, update areas “to more satisfactorily address the concerns” of unit owners and to not “delete obsolete language”! He submitted amendments on Regular and Special assessments. In 1994, President Chuck Neff asked Wayne Bruce to form a Buoy Committee to address collection of in-arrears dues, financing, management of the buoy field on behalf of the buoy owners and standards. A buoy field amendment was recommended. In 1994, Irwin Krauss wrote “indeed good news that the CCR committee is going to submit a list of recommended changes …at the January 1995 meeting.” He included 7 recommended amendments. In 1994, the committee met at my home in Concord to review the 24 amendments identified thus far. In 1994, Harold Winston submitted changes on Section 18 – maintenance of a sales office on the premises.

 

In 1995 the committee presented amendment recommendations. Unfortunately several Board members felt the current CC&Rs were fine and the amendment process was too complicated and expensive. At this time the garage project was underway. The committee under Bob Havranek kept up its efforts. John Kurylo and Ray Weigle were active during this period. After Bob Havranek sold his unit, Sam McMullen became chairman. In 2000, the committee again presented to the Board the most important items in the CC&Rs that should be amended. Unfortunately our recommendations were again dismissed. The amendment process stagnated after that. The nonconformity of the CC&Rs with recent legislation increased with time. Responsibility for recent developments within PineWild needed to be formalized. Issues needed to be addressed. Lex Adams provided much input to the committee at this time. My list of amendments grew to 38.

 

In 2007, Bill Cobb and Sam McMullen co-chaired the CC&R Committee. And the rest is history. Bill brought on Gayle Kern, an attorney representing common-interest communities, to work on the CC&Rs. Two years later, after many, many hours of selfless, exhausting work and meetings, the committee chaired by Bill Cobb obtained the membership ratification of the Restated CC&Rs. This, as the history above shows, is a once-in-a-life-time event!
