Preface

It is important we all recognize that these Rules of Conduct have been compiled for the benefit of all property owners and their tenants and guests. These Rules of Conduct merely clarify precepts which are a part of the Covenants, Conditions and Restrictions of the Condominium Project. They incorporate suggestions proposed by property owners and policies adopted by the Association Board of Directors to assure proper administration and management of the affairs of the Association.

Rules of Conduct are always subject to revision as conditions may change within our PineWild Community. They apply to all property owners, tenants and guests. The intent is that these Rules of Conduct provide a support system for harmonious living in the PineWild Community. We should all have a common interest in observing these Rules of Conduct. In essence, let us all be considerate of one another.

Property owners shall be responsible for notifying all tenants, guests and rental or property management agencies of the content of these Rules of Conduct and the penalties which may be imposed for violation of these Rules of Conduct.

  1. Access
    Access to the Condominium complex is controlled by an electronic gate system which is activated by proper presentation of a gate key. Each condominium unit is entitled to one gate key per bedroom, in accordance with the original building plan, at no cost. Two (2) additional cards may be obtained by the property owner from the Association Office on payment of a deposit of ten dollars ($10.00) per card. Replacement of any lost card will require a fifty dollar ($50.00) service charge.
     
  2. Registration
    Property owners are required to register annually, with the Association Office, all vehicles, pets and boats or other water craft which may be operated or parked within the complex or which may utilize the facilities of the complex. Such registration shall be modified at any time any additions, deletions or changes of any sort occur.

    Tenants and guests are required to accomplish a similar registration by utilizing approved forms provided at the gate entrance or by telephone to the Association Office, at (775) 588-4743, within one hour of their arrival. Only boats of 26 feet or less may be attached to the Buoy.

  3. Parking
    Each condominium unit is assigned exclusive use of one (1 ) numbered parking space within the common area. Such space shall be utilized by the property owner or tenant. Property owners may authorize another property owner to use an assigned space during their absence. The Association Office should be advised, in writing of such authorization.

    A number of guest spaces (marked "G") are provided. Guest parking is limited to either the assigned space or an available guest space. Use of guest spaces is limited to a period of forty-eight (48) hours. It is the responsibility of the property owner to advise tenants and guests of parking regulations. During periods of high occupancy, when all parking areas are being used, it may be necessary that guest's vehicles be parked outside the PineWild complex and the guests be shuttled to and from the complex.

    Parking or storage of motor homes, campers, travel or camping trailers, boats or boat trailers, cargo trailers or commercial trucks is prohibited at all times. When such vehicles are utilized for travel to the complex or being transported to the area and arrival occurs after 5:00 P.M., such vehicles may be legally parked, if space is available, until no later than 7:00 A.M. the following morning.

    Use of any form of recreational vehicle within the complex as living quarters at any time is strictly prohibited./ Parking or storage of vehicles which are not currently licensed or are not operational is prohibited. Parking or storage of any vehicles which have either an overall length of twenty (20) feet or an overall width of eight (8) feet is strictly prohibited. Parking or operation of vehicles on any lawn or other unpaved area is strictly prohibited.

    Owners and tenants have an obligation to inform all guests, visitors or tradesmen, whether social or commercial, where they may park. Guests, visitors or tradesmen are only to use the parking spaces marked with a "G" unless the owner's or tenant's numbered space is made available for them.

    Remember, PineWild has limited parking. Therefore, it is essential that each of us limit the number of vehicles consistently parked in the parking areas.

    Vehicles improperly parked may be towed, at the owner's expense, without notice. Your attention is called to Nevada Revised Statutes 487.038 - Removal of Vehicles Parked in Unauthorized Manner on Private Property.

    Reference to this Statute, which provides the basis for towing vehicles which are improperly parked in an unauthorized manner on private property, is clearly posted at PineWild's entrance gate.

      3.1 Parking Garage Rules of Conduct specific to the use of the Parking Garage shall be developed and published prior to the completion of the construction of such structure.

  4. Speed Limit
    The paved roadway within the complex is a one-way street. The maximum speed limit is 15 mph. Please be cautious of persons walking on the roadways and in the parking areas..
  5. Unlicensed Motorized Vehicles
    The storage or operation of trail bikes, snowmobiles or any other un1icenced motorized vehicles is prohibited within the complex with the sole exception of maintenance equipment owned by the PineWild Condominium Homeowners' Association or other maintenance and repair purveyors whose services may be contracted by the Association.
  6. Unit Occupancy and Rental
    Each unit shall be used only for residential purposes. Occupancy should be limited to two (2) persons per bedroom plus two (2) additional persons. Three (3) bedroom units are, therefore, limited to occupancy by a maximum of eight (8) persons; four (4) bedroom units to a maximum of ten ( 10) persons.

    The owner of any unit may allow, by lease or rental agreement, individuals to share the unit as a residence in such number not to exceed one individual for each bedroom in said unit.

    All rental and property management agencies which may be employed by unit owners shall be informed of these Rules of Conduct. Property owners shall assure that all such rental and property management agencies be required to inform prospective renters of these Rules of Conduct.

    No commercial enterprise shall be conducted within any unit which will create additional traffic within the complex, interfere with the ability of any owner, tenant or guest to utilize parking facilities or otherwise cause any disturbance to other owners, tenants or guests.

  7. Guest Use of Common Areas
    Guests of owners and tenants are authorized to use common area facilities but guests may not invite additional guests to use these facilities.

    Whenever large groups of guests are invited to use the common areas of PineWild, the date, time and place should be cleared with the Association Office so adequate provisions can be made. Security deposits may be required, at the discretion of the Board of Directors, to assure that proper arrangements for clean-up have been made and any damage to the common areas and facilities which may occur shall be repaired.

    Unit caretakers, unless they are in fact tenants or guests, are not entitled to use of the common area facilities.
  8. Abusive Conduct
    Owners, tenants and guests shall be held responsible for abuses of common areas and facilities and for excessive disturbance of other owners, tenants and guests. No activities shall be conducted within the dwelling units or upon the deck areas between the hours of 10:00 P.M. and 10:00 A.M. which may disturb other owners, tenants and guests.

    The volume of radios, tape decks, stereos, televisions or other electronic audio equipment may not be set to an objectionable level within condominiums, on decks or porches, in parked vehicles or on the beach which might disturb others. Radios, tape decks or stereos or other electronic audio equipment installed or otherwise contained within parked vehicles may not be played so loudly as to disturb others.

    Parents are responsible for any destruction or vandalism to the common areas or facilities which may be caused by children.

    Persistent barking or other noise generated by pets shall not be allowed. Pets shall be kept on leashes or under the direct control of the owner and shall not be allowed to run free and unsupervised within the complex. Pets shall not be allowed on the beach from May through September. Owners shall, when walking pets, be equipped with proper tools and containers to assure droppings are collected and removed from the common areas.

    Hot tubs or spas located on decks, their circulation pumps and other accessories may be used only between the hours of 10:00 AM. and 10:00 P.M. All hot tubs, spas and related equipment shall be enclosed in one (1) soundproof enclosure and shall be covered and locked when not in use.
  9. Health and Safety Concerns
    Garbage should be disposed of in the bins provided for that purpose both along the parking areas and on the beach. Compactor bags should be utilized to prevent overloading of dumpsters and to keep the costs of collection and disposal of trash to a minimum.

    Never place hot ashes from fireplaces or barbeques in the dumpsters. Separate closed containers are provided for the collection of ashes.

    It is essential that all owners, tenants and guests insure that charcoal barbeque fires on the decks are completely extinguished after each use. All charcoal barbeque implements should be fitted with manufacturer provided ash collection devices or adequate non-combustible protective devices should be installed beneath the barbeque to protect the decking. The fire hazard to the living units and connecting units is extreme.

    Burning of certain fuels or materials in fireplaces leads to an accumulation of dangerous combustible deposits in chimneys and flues. Owners should assure that fireplaces, chimneys and flues are inspected annually and that such combustible deposits are removed whenever necessary./Open fires on the beach and in the common areas are prohibited by Article 11 of the Uniform Fire Code.

    The use of barbeque equipment is limited to condominium decks and must not be used on the beach or within the common areas.

    Ball games of any sort and other recreational activities are prohibited on the asphalt areas or near the buildings where windows can be broken or other damage or injury to persons can occur. Such games are limited to the large grassy areas and the beach.

    Flower pots, statues and decorative pieces should not be placed on deck railings where they may fall on persons below. For the aesthetic benefit of all owners, tenants and guests, hanging towels and articles of clothing from deck railings or installing clotheslines on decks is prohibited.

    The use of fire arms, BB guns, air rifles or air pistols is strictly prohibited within the complex.

    Fuel which may be utilized for the operation of personal water craft, trail bikes, snowmobiles or other recreational equipment should be purchased only as required and stored in approved safety containers. Excessive amounts shall not be stored within the complex. Under no circumstances shall volatile fuels be stored within or beneath dwelling units or under decks. Care should be taken to assure that volatile fuels of any sort are not kept near any source of heat which may cause expansion and leakage or ignition of such fuels. Common sense dictates that, when transferring fuels from storage containers to equipment tanks, other persons are not endangered and that appropriate fire extinguishers are readily available.

    Assistance for fire, ambulance, law enforcement and water emergency situations may be summoned by dialing 911. Non emergency assistance and information may be acquired by calling the Tahoe Douglas Fire Protection District, (775) 588-3591; Douglas County Sheriff, (775) 586-7650; and the U.S. Coast Guard, (530) 583-4433.
  10. Feeding Wild Animals
    Our condominium complex is located adjacent to National Forest areas. Accordingly, we are often visited by a variety of wild animals. It is not unusual to observe geese and other birds, raccoons, squirrels (which may well carry plague), as well as bear and coyote. It is imperative that PineWild homeowners, residents and their guests understand that these are wild animals and should not be fed. It is not healthy for the animals and could prove to be harmful to our neighbors and pets.
  11. Sunbathing
    Nude sunbathing is prohibited on decks, the beach, and in all common areas within the complex.
  12. Boating and Water Activities
    A specially marked area enclosed by floats is reserved for swimmers only. Power boats are strictly forbidden inside the swimming area. The pier is not located in the marked swimming area. Swimmers should recognize the inherent danger to themselves by swimming in the pier area where boats may be maneuvering.

    The legitimate use of the pier by boaters is for the loading and unloading of passengers only. It is not to be used for lengthy or overnight tie-up of boats.

    Buoys in the buoy field are privately owned by individual homeowners, and utilization of any buoy is prohibited without the owner's permission.

    The buoy field and mooring pattern within that field is regulated by several Federal, State and local agencies. Additional moorings cannot be established without the proper and required filing of applications and issuance of official approvals. This process can take several years to accomplish.

    Boats which exceed twenty five (25) feet in length cannot be safely accommodated in PineWild's agency approved buoy pattern and therefore are prohibited.

    Boating safety regulations in waters adjacent to the PineWild complex are strictly enforced by the U.S. Coast Guard and the Douglas County (NV) Sheriff. Elsewhere on Lake Tahoe, the City of South Lake Tahoe (CA) Police Department, El Dorado County (CA) Sheriff, Placer County Sheriff (CA) and Washoe County (NV) Sheriff will also strictly enforce all applicable Federal, State and local boating regulations. The maximum boat speed shall not be in excess of five (5) miles per hour within two hundred (200) feet of any shoreline, dock, buoy field or designated swimming area. Since Lake Tahoe is by definition a navigable waterway, the Navigation Rules for Inland Waters apply. Personal water craft must abide by these regulations. Water skiers are prohibited from skiing off, or landing on the beach or pier.
  13. Tennis Court Rules
    Please consult the separate Tennis Court Rules for conduct and sign-up procedures applicable to that portion of the common area of the PineWild complex.
  14. Enforcement of Rules of Conduct
    Owners, tenants and guests who violate these Rules of Conduct subject themselves to loss of use of the PineWild common area facilities and potential fine in the amount of fifty dollars ($50.00) as provided for in the Covenants, Conditions and Restrictions of the Project.
  15. Architectural Design
    The Covenants, Conditions and Restrictions of the PineWild Condominium Project prohibit any alterations or additions to the buildings or common areas without the prior approval of the Architectural Committee. The Architectural Committee meets quarterly in conjunction with the meetings of the PineWild Condominium Homeowners' Association Board of Directors.
  16. Sun Shade Policy
    Opening and closing day: May 1 to Oct. 15./Size not to exceed 10x10, no side panels.

    Place sunshades as close as possible to bushes without damaging bushes.

    20 feet from each side of walkways for day use only. (These cabanas and all beach items must be removed at the end of each day).

    Sunshades/cabanas and watercraft left over night must have their unit number visible for security to see.

    The beach will be raked every Wednesday at 8:00 am to 12:00 p.m. except July 4th. All items from beach must be removed off of common area except sunshades/cabanas Pinewild manage identifies as belonging to units who are currently present (larger water craft may be temporarily placed at the south end of the beach). This will allow staff to rake the beach and make any necessary improvements if needed. It will also help keep track of sunshades/cabanas and other items that are abandoned.

    Any items that appear damaged or abandoned will be removed and discarded by staff.

    Homeowners will be assessed a removal fee of $50.00 for any sun shades or other beach items that the staff will need to remove to comply with policy.

    Due to secure storage constraints, Pinewild is not responsible for items removed from the beach. These items will be discarded.
